Supreme Court Orders Rehearing of Kazinda Petition

Kampala, Uganda: The Supreme Court of Uganda has ordered a rehearing of the petition filed by opposition figure Joseph Kazinda challenging the results of the 2026 parliamentary elections.

In a brief statement issued on Wednesday, the court directed that the petition be scheduled for a fresh hearing, citing procedural irregularities during the initial proceedings that could have affected the fairness of the judgment.

The court did not provide a detailed explanation for its decision but emphasised the need for due process and adherence to legal standards.

Kazinda, a long-time critic of the electoral process, had argued that irregularities and administrative lapses by the Electoral Commission compromised the integrity of the election in his constituency.

His petition, originally dismissed by the High Court, had been appealed to the Supreme Court.

Legal analysts say the decision to rehear the case underscores the judiciary’s caution in politically sensitive matters, especially given the nationwide attention on the 2026 elections.

“This is a critical test of the judiciary’s independence,” said prominent election lawyer Sarah Namutebi. “A rehearing allows all parties to present their case thoroughly and ensures that justice is not only done but seen to be done.”

Kazinda has welcomed the Supreme Court’s directive, pledging full cooperation and urging the Electoral Commission to provide all necessary records for a transparent hearing.

The Electoral Commission has not yet issued a formal response, but sources indicate that it is preparing to defend the validity of the contested results. The new hearing date is expected to be set within the coming weeks.
